Newswire Talk attorney to me: Chicago hair band sues Poison for stealing its material

Apparently there’s no statute of limitations on hair metal thievery. Members of Kid Rocker—yeah, that’s right—a Chicago band that tore up the Hollywood club scene in the ’80s, are suing the members of Poison for infringing on the copyright of four of the band’s songs. Kid Rocker’s Billy McCarthy and James Stonich are alleging that gravel-voiced C.C. DeVille auditioned for the group in 1984, a bit before he joined Poison. During that time, he was giving access to master tapes and completed versions of Rocker songs, including “Hit And Run” and the excellently named “Wham Bam Slammin’ Romance.” Kid Rocker disbanded before DeVille could join, but parts of its songs allegedly turned up in four different Poison songs: “Talk Dirty To Me,” “I Won’t Forget You,” “Fallen Angel,” and “Ride The Wind.”

Poison’s debut album, Look What The Cat Dragged In, sold four million copies, and the band’s members continue to tour and land in VH1 reality dating shows based on their ’80s success.
